Terms of Service

1. Acceptance of Terms
By accessing or using our website (www.techbound.co.za) and our tech repair services, you agree to be bound by these Terms of Service. If you do not agree, please not use our services.
2. Services Provided
We offer diagnostic, repair, replacement, and maintenance services for electronic devices including but not limited to: computers, and other consumer electronics ("Services").
3. Estimates & Pricing
Diagnostic Fee: A non-refundable diagnostic fee may apply. This fee will be disclosed before any work begins.
Repair Quotes: Quotes are valid for no more than 30 days. Final price may change if additional damage is found after disassembly.
Payment: Full payment is due upon completion of the repair unless a different arrangement is made in writing. We accept EFT or Cash.
4. Data Loss & Backup
You are solely responsible for backing up all data, files, and software on your device before handing it over for repair.
We are not liable for any loss, corruption, or alteration of data, even if caused by our negligence, unless required by law. We strongly recommend you perform a full backup (iCloud, Google Drive, external hard drive, etc.) prior to service.
5. Repair Process & Timeframes
We will provide an estimated completion time, but delays may occur due to part availability or unforeseen issues.
If we cannot repair your device, you will only be charged the diagnostic fee (if any) unless you approve alternative parts/repairs.
6. Parts & Components
We use new, used, or refurbished parts of comparable quality unless you request otherwise in writing.
Parts replaced during a repair become our property unless you request them returned (shipping costs may apply).
7. Warranty on Repairs
Labor Warranty: 90 days on labor from the date of repair.
Parts Warranty: 90 days to 1 year on parts supplied by us.
What voids warranty: Physical damage, liquid damage, tampering by a third party, improper use, or software modifications.
What is not covered: Pre-existing issues, software problems, data loss, or subsequent damage caused by the original issue.
Exclusive remedy: If a defect covered by warranty arises, we will re-repair or refund the repair cost (at our option) within the warranty period.
8. Limitation of Liability
To the maximum extent permitted by law:
Our total liability for any claim arising from our Services shall not exceed the amount you paid for the specific repair in question.
We are not liable for:
• Lost data or software
• Lost profits, business interruption, or incidental/consequential damages
• Damage caused by pre-existing defects that we could not reasonably discover
9. Indemnification
You agree to indemnify and hold harmless The Tech Guru, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
• Your violation of these Terms
• Your misuse of the repaired device
• Any data or content you provided
10. Abandoned Devices
If you do not pick up your device within 60 days after we notify you that the repair is complete, we may consider the device abandoned. We may dispose of or recycle abandoned devices with no liability to you, and you waive any claim to the device.
11. Privacy & Personal Information
Our collection and use of your personal information is described in our www.techbound.co.za/tos. By using our Services, you consent to that collection and use.
12. Changes to These Terms
We may update these Terms at any time. Material changes will be posted on our website or emailed to you (if we have your address). Continued use of our Services after changes means you accept the revised Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of South Africa, without regard to conflict of law principles.
Dispute Resolution: Any dispute shall first be attempted to be resolved through informal negotiation. If unresolved, the dispute shall be submitted to binding arbitration in East London, under the rules of National Consumer's Commission (NCC), unless otherwise required by law.
14. Severability
If any part of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
